Priorités de la Suisse pour la 74e session de l’Assemblée générale de l’ONU

La Suisse fixe ses priorités pour la 74e Assemblée générale des Nations Unies. Le Conseil fédéral a été informé, lors de sa séance du 13 septembre, du résultat des consultations des commissions de politique extérieure. Les priorités portent sur l’engagement en faveur des droits de l’homme, le soutien aux processus de réforme de l’ONU et la promotion de la diplomatie scientifique. Le président de la Confédération Ueli Maurer et le conseiller fédéral Ignazio Cassis représenteront la Suisse lors de l’ouverture, fin septembre, de la semaine de haut niveau de l’Assemblée générale de l’ONU.

Le Conseil fédéral renonce à simplifier l’approbation des accords de libre-échange

Après avoir pris connaissance des résultats de la consultation, le Conseil fédéral a décidé, le 28 août 2019, de ne pas établir de message concernant la loi fédérale sur l’approbation des accords de libre-échange. La loi prévoyait que les accords « standard » soient approuvés par arrêté fédéral simple, autrement dit qu’ils ne soient plus assujettis au référendum facultatif applicable aux traités internationaux.

Arrêt du 22 mai 2019 (6B_378/2018) Expulsion pénale de ressortissants européens et ALCP : pas d'interprétation restrictive des exceptions en droit pénal

Le  Tribunal  fédéral  examine  de  manière  approfondie  le rapport  entre  l'expulsion pénale de ressortissants européens et l'Accord sur la libre circulation des personnes (ALCP)   entre   la   Suisse   et   les   Etats   membres   de   l'Union   européenne   (UE).   Les restrictions à la libre circulation des personnes, notamment pour des raisons d'ordre public, telles qu'envisagées par l'ALCP, lequel est motivé en premier lieu par des considérations de droit économique, ne doivent pas être interprétées restrictivement en droit pénal, mais sur la base du sens littéral de la disposition  pertinente de l'ALCP. Dans le cas concret, l'expulsion d'un espagnol condamné à une peine avec sursis pour trafic de drogue, prononcée par le Tribunal cantonal zurichois, n'est pas contestable.

Arrêt détaillé du Tribunal fédéral concernant une demande d'assistance administrative de la France

Le Département fédéral des finances (DFF) a pris acte de l'arrêt détaillé rendu aujourd'hui par le Tribunal fédéral concernant une demande d'assistance administrative déposée par la France au sujet de données de clients d'UBS. L'arrêt sera analysé en profondeur dès que la motivation écrite sera disponible.

 

Lors d'une audience publique qui s'est tenue aujourd'hui, le Tribunal fédéral a rendu un arrêt détaillé sur une demande d'assistance administrative adressée par la France à la Suisse. Il a admis le recours que l'Administration fédérale des contributions avait déposé contre une décision prise le 30 juillet 2018 par le Tribunal administratif fédéral et a approuvé, ce faisant, la livraison de données de clients d'UBS à la France. Il précise toutefois l'utilisation des données dans des procédures contre des tiers (respect du principe de spécialité).

Le DFF a pris acte de l'arrêt du Tribunal fédéral, qu'il analysera en profondeur une fois que la motivation écrite sera disponible. Le président de la Confédération et chef du DFF, Ueli Maurer, a affirmé que la place financière suisse remplit les normes internationales. Il a expliqué que l'arrêt concerne l'assistance administrative dans ce cas concret qui remonte à plusieurs années et, qu'à l'avenir également, toute demande d'assistance administrative sera examinée en détail pour déterminer si les conditions de transmission des données sont pleinement satisfaites.

41ème session du Conseil des droits de l’homme – La Suisse présente avec succès deux résolutions

Le Conseil des droits de l’homme (CDH) clôt aujourd’hui à Genève sa 41ème session. Dans ce cadre, la Suisse a présenté avec succès deux résolutions : la première portant sur les mariages forcées et d’enfants et la seconde en faveur de l’égalité salariale.

The 2019-2020 SVIR International Tribunals Internship Grant

The Swiss Association of International Law (SVIR) is pleased to present the SVIR International Tribunals Internship Grant. The award will support a post-graduate student or graduate of a Swiss law school to undertake an internship with:

  • The International Court of Justice (ICJ), The Hague
  • The International Criminal Court (ICC), The Hague;
  • The International Tribunal for the Law of the Sea (ITLOS), Hamburg;
  • The UN International Residual Mechanism for Criminal Tribunals (ICTM), The Hague;
  • The Special Tribunal for Lebanon (STL), The Hague.

by providing a financial contribution to cover the cost of travel to the Netherlands or Germany and a contribution towards living expenses.

The successful intern must have been accepted for an internship of at least 4 months during the year 2019 or in the first semester of 2020 in one of the abovementioned tribunals.

Selection criteria:

The applicant must:

  • Be Swiss, a permanent resident of Switzerland or pursuing a course of law studies at a Swiss University and:
  • Hold a graduate level degree in Law (MLaw) of a Swiss University (or be in his or her final year of such a degree); or
  • Be undertaking a postgraduate degree in Law (e.g. LLM or PhD) at a Swiss University;
  • Have an excellent academic record;
  • Have written and spoken proficiency in English or French, with preference given to those who are also proficient in the other;
  • Have an interest or specialization in a field relevant to the respective tribunal; and
  • Be accepted by the abovementioned tribunals for an internship.

How to apply

You must first apply and be accepted for an internship in one of the abovementioned tribunals. Applications close on 3 September 2019.

 

 

The motivation letter should include:

  • The applicant’s reasons for applying for the SVIR International Tribunals Internship Grant;
  • The dates when the applicant will undertake his or her internship.

Please also enclose the following, where applicable:

  • Proof that you have been accepted by one of the abovementioned tribunals for an internship
  • Your up-to-date CV;
  • Your most recent academic transcript;
  • At least one academic reference, with contact details of referees;

Selection process

  • Applications will be considered by a selection panel appointed by the SVIR.

Conditions

  • The amount of the scholarship to be paid is of maximum CHF 3’000.-
  • The internship must generally be unpaid although the recipient may seek to obtain other scholarships.
  • The successful applicant is responsible for organising his or her own travel and accommodation arrangements, visa requirements and any other requirement by the tribunal he or she has been selected for.
  • On completion of the internship, the successful applicant must provide a written report on his or her experience to the Board for SVIR/SSDI.

Rosalyn Higgins Prize 2019

The Law & Practice of International Courts and Tribunals now invites submissions for the Rosalyn Higgins Prize

In light of her outstanding and inspiring achievements in the field of international dispute settlement, the Law & Practice of International Courts and Tribunals (LPICT) has named a Prize in honour of H.E. Rosalyn Higgins.

The Rosalyn Higgins Prize is an annual prize which awards EUR 1.000 of Brill book vouchers and a LPICT subscription to the author of the best article on the law and practice of the International Court of Justice, either solely focusing on the ICJ or with the ICJ as one of the dispute settlement mechanisms under consideration. The winning article will also be published in LPICT and made freely available online to maximize its dissemination.

Competition for the Prize is open to all: scholars as well as practitioners, junior as well as senior professionals. Submissions will be selected via a double-blind peer review process by a Prize Committee, including both co-Editors-in-Chief.

Exceptionally, two papers of an equally high standard can be selected. The Committee is also able to choose not to award the Prize if in its opinion none of the submitted papers reaches the required standards.

Submissions should be between 6.500 and 8.000 words in length, not yet published or under review elsewhere. Other submission requirements are the same as for regular LPICT submissions (instructions available here).

Le Nigéria doit libérer le «San Padre Pio» avec son fret et son équipage

Le Tribunal international de la mer  à Hambourg a décidé aujourd'hui que le navire "San Padre Pio", battant pavillon suisse, devait être libéré avec l'équipage et la cargaison. La Suisse se félicite de cette décision. Avec cette décision, la demande de la Suisse a été en grande partie acceptée.

CEDH: Premier jugement pour non-respect d'un jugement antérieur

Le 29 mai 2019, la Grande Chambre de la Cour européenne des droits de l'homme a rendu son premier arrêt dans une procédure d'infraction au titre de l'article 46 § 4 (force obligatoire et exécution des arrêts) de la Convention européenne, constatant que l'Azerbaïdjan n'avait pas rempli ses obligations une décision de 2014.
