Candidatures pour le Prix de la SSDI 2021 - délai: 31 mars 2021

Le Prix de la Société suisse de droit international, qui a été créé en 2017, est décerné annuellement à la meilleure thèse de doctorat ou d’habilitation réalisée en droit international public, en droit international privé, en droit européen ou en droit comparé, soutenue dans une université suisse, dans une université étrangère associée à une université suisse ou encore dans une autre université étrangère, si le candidat possède la nationalité suisse. Les thèses présentées peuvent être rédigées en allemand, en français, en italien ou en anglais.

Le prix, dénommé « Le prix de la Société suisse de droit international », prend la forme d’une aide à la publication d’un montant de CHF 1000.-.

Un Jury, élu par le Comité de la SSDI, décide de l’attribution du prix. Il est composé de 5 membres qui représentent les domaines du droit international public, du droit international privé, du droit européen et du droit comparé. Les modalités de candidature et la date limite de dépôt de celle-ci figurent sur la page consacrée à la candidature.

Le prix de la SSDI est officiellement décerné lors d’un événement scientifique ou lors de la Journée de droit international de la Société suisse de droit international.

Le calendrier des prix est organisé sur la base de l’année civile. Pour les ouvrages parus ou les thèses soutenues durant l’année 2020, la candidature devra être adressée au secrétaire de la SSDI avant le 31 mars 2021, pour une attribution du prix en 2020.

Les thèses de doctorat ou d’habilitation doivent donc avoir été soutenues entre le 1er janvier 2020 et le 31 décembre 2020.

Les candidats doivent adresser leur candidature au secrétaire de la SSDI, M. Stefan Breitenstein, avant le 31 mars 2020, en précisant le titre de la thèse, la date de soutenance et les autres éléments utiles indiqués dans le Règlement du Prix de la SSDI. Le dossier de candidature doit aussi comprendre un curriculum vitae, trois exemplaires papier et une version électronique de la thèse. Le secrétaire les informera ensuite de la recevabilité de leur candidature et assurera le suivi pour le bon déroulement de la procédure.

La demande doit comprendre un résumé de la thèse de doctorat ou de post-doctorat, qui sera publié dans la Revue suisse de droit international et européen si elle est de qualité appropriée. Le résumé doit être rédigé sans notes de bas de page ni sous-titres et ne doit pas dépasser le nombre de mots maximum de 1'000. De plus amples informations sont disponibles sur le site www.sriel.ch.

Violents affrontements entre l’Arménie et l’Azerbaïdjan: position de la Suisse

Berne, 28.09.2020 - La Suisse est préoccupée par les affrontements violents persistant entre l’Arménie et l’Azerbaïdjan, qui s’intensifient depuis le 27 septembre. Au vu des récents événements, elle invite les parties à préserver la stabilité régionale et, partant, à ne plus recourir à la force.

La Suisse rappelle aux deux parties qu’elles doivent honorer les obligations que leur impose le droit international, en particulier celle qui consiste à protéger la population civile. Des négociations de fond doivent reprendre dans les meilleurs délais sans conditions préalables puisqu’il s’agit de la seule voie susceptible de parvenir à un règlement pacifique du conflit. La Suisse soutient sans réserve les efforts des coprésidents du Groupe de Minsk visant une solution négociée au conflit et se dit prête à accueillir des rencontres au plus haut niveau comme elle l’a déjà fait par le passé.

Nachruf: Luzius Wildhaber, Professor und ehemaliger Präsident des Europäischen Gerichtshofs für Menschenrechte

Wir sind tief betroffen vom Tod von Prof. Dr. Luzius Wildhaber. Er hat nicht nur eine herausragende Rolle in Lehre, Forschung und Praxis des Völkerrechts gespielt, unter anderem von 1998-2007 als erster vollamtlicher Präsident des Europäischen Gerichtshofs für Menschenrechte (EGMR). Er war auch von 1972-1990 Präsident unserer Vereinigung und ist bis 1998 Vorstandsmitglied geblieben. Der Verstorbene hat sich nicht nur für das internationale Recht im allgemeinen und in der Schweiz im besonderen sondern auch für die Schweizerische Vereinigung für internationales Recht immer stark eingesetzt. Er ist bis zum Tag seines Todes unser geschätztes Mitglied geblieben.

Das Lebenswerk des Verstorbenen als Wissenschaftler und Richter ist einzigartig. Begonnen hat er mit Rechtsstudien in Basel, Paris, Heidelberg, London und New Heaven (USA), welche mit einem Doktorat der Rechte in Basel, einem LL.M. und J.S.D. in Yale und einem Basler Anwaltspatent abgeschlossen wurden. Nach kurzer Zeit beim Völkerrechtsdienst des EDA wurde er schon im Jahre 1971 als Professor für Völker-, Staats- und Verwaltungsrecht an der Universität Freiburg i. Ue. gewählt. 1977 folgte der Ruf nach Basel, wo er in den Jahren 1992-1994 auch das Amt des Rektors ausübte.

Als Richter war er insbesondere seit 1991 Mitglied des damaligen nebenamtlichen Europäischen Gerichtshofs für Menschenrechte und nahm aktiv an dessen Reform teil. Seit seiner Wahl zum ersten Präsidenten des neuen hauptamtlich tätigen Gerichtshofs war er für zehn Jahre der höchste Schweizer Verantwortungsträger in einer internationalen Organisation. Durch sein nie aufgegebenes «Hin- und Her-Wandern» zwischen der Profession als Wissenschaftler und als Richter hat er die Rechtsprechung der Europäischen Gerichtshofs für Menschenrechte wie auch dessen wachsendes Selbstverständnis als Europäisches Verfassungsgericht gegenüber den Vertragsstaaten und den anderen internationalen Gerichtshöfen massgeblich mitgeprägt. Jahrelang und über seine Mandatszeit hinaus wies er auch darauf hin, dass das weltweit wirksamste Menschenrechtsschutzsystem weiterer Reformen bedarf, wenn es nicht Opfer seines eigenen Erfolgs werden will. Mit verschieden Initiativen hat er auch zu solchen Reformen beigetragen, welche er jedoch bis zu seinem Tod als ungenügend ansah. Man könnte somit die Präsidialzeit des Verstorbenen als «Wildhaber-Years» des Ausbaus und der Konsolidierung des EGMR bezeichnen.

Hochgeschätzt war Luzius Wildhaber auch als akademischer Lehrer. Sein praxis-orientierter Ansatz war vielen seiner Schülerinnen und Schüler, die heute selbst lehren, ein Vorbild. Er hat es mit seiner offenen, studierendenfreundlichen und doch anspruchsvollen Art verstanden, die Studierenden für die Grundfragen des Völkerrechts, aber auch des Staats- und Verwaltungsrechts zu interessieren und ihnen ein kritisches juristisches Denken zu vermitteln. Anhand von aktuellen, der Völkerrechtspraxis entlehnten farbigen Beispielen vermochte er sie für dieses Gebiet zu begeistern. Seine Vorlesungen und das zusammen mit Jörg Paul Müller verfasste Lehrbuch «Praxis des Völkerrechts», die der im angelsächsischen Raum geläufigen didaktischen Methode der «Case Studies» folgten, haben Generationen von Studierenden davon überzeugt, dass die Darstellung des Völkerrechts vom konkreten Fall her der Eigenheit dieses Rechtsgebiets besonders gerecht wird.

Den Studierenden und Doktorierenden des Verstorbenen ist auch seine respektvolle Weise in lebhafter Erinnerung, wie er ohne dogmatische oder politische Voreingenommenheit auch auf kritische Fragen einging und das wirkliche Anliegen der Fragenden heraushörte und aufnahm. Sie werden auch seinen trockenen Humor nie vergessen.

Neben der Aufgabe als Professor hat sich Luzius Wildhaber immer auch dem Gemeinwesen als unbestechlicher Ratgeber und Gutachter zur Verfügung gestellt. Wo Rat und Tat des Verstorbenen national oder international gesucht waren, wirkte er, mit Leichtigkeit in verschiedenen Sprachen sprechend und denkend, als Mann der Nuancen, der sorgfältig abwägenden und geistreichen Argumentation, die schliesslich in eine intellektuell und ethisch überzeugende Beurteilung mündete. Offenheit, Unvoreingenommenheit und Weitblick, verbunden mit einem hohen Mass an gesundem Menschenverstand, kennzeichneten die Urteilsgabe des Verstorbenen.

Versucht man, das Schaffen von Luzius Wildhaber als Wissenschaftler und Richter in wenigen Worten zusammenzufassen (und dabei etwa seinen Einsatz für Umweltschutz, auch durch Völkerrecht vernachlässigt), so steht im Mittelpunkt wohl seine Leitidee, wonach die Festigung und Fortentwicklung der Menschenrechte und ihrer richterlichen Überprüfung und Durchsetzung eine unverzichtbare Grundlage für Gerechtigkeit, Frieden, Fortschritt und Sicherheit in Europa und in der Welt bilden. In zahlreichen Schriften, Voten und Vorträgen hat der Verstorbene auf den inneren Zusammenhang von Menschenrechten, Demokratie und Rechtsstaatlichkeit hingewiesen. Dass dabei Rechtswissenschaft und Rechtswirklichkeit näher zusammenrücken müssen, sind eine Erkenntnis und eine Forderung, die der Verstorbene wiederholt und in klaren Worten vertreten hat. Auch im Professor las und hörte man den Richter, und im Richter erkannte man den Professor.

Die SVIR, ihre Präsidentin und ihr Vorstand werden ihren ehemaligen Präsidenten Luzius Wildhaber in ehrendem Gedächtnis behalten, sich weiterhin für seine Ideen einsetzen und drücken den Hinterbliebenen, insbesondere seinen beiden Töchtern Anne und Isabelle, die beide Juristinnen wurden und in Lehre Forschung und Praxis tätig sind, ihr aufrichtig empfundenes Beileid aus.

 

Tribunal fédéral: Détention pour des motifs de sûreté ordonnée dans la procédure ultérieure compatible avec la CEDH

La détention pour des motifs de sûreté, ordonnée par le Tribunal cantonal valaisan dans une procédure ultérieure relative à une mesure envers un délinquant pédo sexuel, susceptible de récidiver, est compatible avec la Convention européenne des droits de l’homme (CEDH). Le Tribunal fédéral arrive à cette conclusion après avoir examiné un récent arrêt de la Cour européenne des droits de l’homme.

CALL FOR PAPERS : Human Rights and the Climate Change Crisis - Ethical Implications and the Human Rights to Development and a Healthy Environment

University of Geneva, Thursday 26 and Friday 27 November 2020

The current pandemic highlights the urgent need for global measures to deal with common threats and the risk that such measures could be taken at the expense of individual freedoms. These uncertain times may present an opportunity to rethink society and the economy to combat climate change more effectively, exploring whether a new balance between individual freedoms and collective goals could be sought. This workshop will examine the relationship between climate change and human rights from three angles:

1) How should the promotion of collective interests be balanced with individual freedoms?

The first session will set out the philosophical and ethical challenges raised by policy measures to mitigate climate change, focusing on the impacts of the collective fight against climate change on individual freedoms. On the one hand there is the risk of a possible irreconcilable tension between the liberal approach of minimal interference in individual freedoms and the need for urgent action at national and global level to combat climate change. On the other hand, there is a collective as well as individual moral responsibility that could justify limitations on personal freedoms to prevent environmental harms that threaten humanity as a whole.

2) Is the human right to development compatible with the human right to a healthy environment?  

The second session will address another possible conflict which may appear in the context of the relationship between the right to development and the right to a healthy environment. Although the 1986 UN Declaration on the Right to Development does not include any specific duties on environmental protection, it is today well accepted that development and environment cannot be separated, and that they are two faces of the same coin. The 2030 Agenda on Sustainable Development and the 2015 Paris Agreement on Climate Change link economic and social development with the protection of human rights and climate change. Although the concept of sustainable development is extensively used to avoid addressing potential conflicts, its implementation in the context of specific economic projects raises challenges.

3) How should the human right to a healthy environment be enforced?

The third session will focus on the enforcement of the human right to a healthy environment. This panel will build on the work of the former and current UN Special Rapporteurs on the right to a healthy environment as well as on the practice of the Human Rights Council and the UN human rights treaty mechanisms, notably the UN Committee on Human Rights. It will also consider how this right may be enforced through judicial mechanisms – both domestic and international – and what the implications of a global recognition of this right are.  

Organised under the auspices of the Global Studies Institute (University of Geneva), the Geneva Academy of International Humanitarian Law and Human Rights, the Federal Department of Foreign Affairs, the Office of the United Nations High Commissioner for Human Rights, and the Canton of Geneva, this workshop brings together graduate and postgraduate researchers (selected on the basis of their proposals) with experienced academics and practitioners (by invitation).

Eligibility: Graduate and postgraduate researchers having obtained their PhD within the past 10 years.

  • Applicants are invited to submit proposals of up to 500 words, in English, plus a short biographical note of 100 words, and 5 keywords to Alice Breathe (alice.breathe@unige.ch) by Friday 29 May 2020.
  • Applicants whose proposals have been selected will be informed by Monday 15 June 2020.
  • Draft papers, of about 8,000 words in English, to be submitted by selected applicants will be due by Wednesday 30 September 2020.

An academic publication will follow the conference.

Racisme et intolérance: le Conseil de l’Europe publie le sixième rapport sur la Suisse

Berne, 19.03.2020 - Dans son sixième rapport sur la Suisse, la Commission européenne contre le racisme et l’intolérance (ECRI) salue les progrès réalisés dans la lutte contre le racisme, et formule de nouvelles recommandations. Ce rapport paraît aujourd’hui, après avoir été approuvé par le Conseil de l’Europe.

Si la commission du Conseil de l'Europe salue les progrès réalisés, elle émet aussi des critiques et formule une série de recommandations, dont la mise en œuvre sera examinée dans le prochain rapport sur la Suisse. Le Conseil fédéral a pris connaissance du rapport et des recommandations lors de sa séance du 12 février 2020.

La Commission européenne contre le racisme et l'intolérance (ECRI) a été créée en 1993 par les chefs d'États et de gouvernement des États membres du Conseil de l'Europe. Elle se compose d'experts indépendants de chaque État membre. Dans ses rapports périodiques par pays, elle contrôle si les recommandations faites dans les précédents rapports ont été appliquées. Élaborés en toute indépendance par la commission, ces rapports se fondent sur l'analyse de documents et la visite d'une délégation dans le pays concerné.

Switzerland’s Federal Criminal Court has postponed the long-awaited war crimes trial of former Liberian rebel leader Alieu Kosiah due to the rapid spread of Covid-19. The trial had been scheduled to take place from April 14-30 in Bellinzona, capital of Switzerland’s southern, Italian speaking canton of Ticino. It will be the first international criminal trial in a non-military Swiss court and “historic” according to Swiss group Civitas Maxima, one of the NGOs representing Liberian victims in the case. The Federal Criminal Court hopes to reschedule the trial between June and July 2020, according to a recent press release from Civitas Maxima and its Liberian partner, the Global Justice and Research Project (GJRP). They said the decision taken by the Swiss court was appropriate to “safeguard the health of all the trial participants, including the victims who reside abroad”, since Liberian witnesses are being called to testify in the trial. Transferts Dublin vers la Bulgarie : pas de défaillances systémiques, mais analyse au cas par cas

Le Tribunal administratif fédéral (TAF) a examiné la situation des requérants d’asile en Bulgarie dans le cadre des transferts Dublin. Il parvient à la conclusion que la procédure d’asile et les conditions d’accueil en Bulgarie ne présentent pas de défaillances systémiques justifiant un arrêt complet des transferts vers ce pays. C’est sur la base d’un examen au cas par cas qu’il s’agit de déterminer s’il s’impose ou non de renoncer au transfert du requérant d’asile concerné vers ce pays.

Tribunal fédéral: Droit des réfugiés à des rentes pour enfant de l'AI : le domicile et la nationalité des enfants ne sont pas déterminants

Les réfugiés reconnus, au bénéfice d'une rente de l'AI, ont en principe aussi droit à des prestations accessoires pour enfant (rentes pour enfant d'invalide) qui ne vivent pas en Suisse. La Convention de Genève sur les réfugiés garantit à cet égard les mêmes droits aux réfugiés qu'aux ressortissants suisses. Une solution nationale divergente ne saurait être appliquée, car il n'existe pas d'indices permettant
